1. Definitions
- Clover Living: Clover Living BV, located in Eindhoven under Chamber of Commerce number 84395575.
- Customer: the person with whom Clover Living has entered into an agreement.
- Parties: Clover Living and the customer together.
- Consumer: a customer who is also an individual and acts as an individual.
2. Right of withdrawal
2.1 A consumer may cancel an online purchase during a 14-day cooling-off period without giving any reason, provided that:
- it is not a product that can spoil quickly, such as food or flowers;
- it is not a product made or modified specifically for the consumer;
- it's not a gift card;
- it is not a product that cannot be returned for hygienic reasons (underwear, swimwear, etc.);
- the seal is still intact if it is data carriers with digital content (DVDs, CDs, etc.);
- the product is not a trip, ticket, catering order or form of leisure activity;
- the product is not a loose magazine or newspaper;
- It does not involve (order for) emergency repairs; and
- the consumer has not waived his/her right of withdrawal.
2.2 The 14-day cooling-off period referred to above in paragraph 1 begins:
- The day after the consumer receives the last product or part of 1 order;
- once the consumer receives the first subscription product;
- once the consumer has acquired a service for the first time; or
- once the consumer has confirmed that he will purchase digital content over the Internet.
2.3 During the cooling-off period, the consumer will handle the product and the entire packaging with care. It will only unpack or use the product to the extent necessary to assess whether it wishes to keep the product. If the consumer makes use of his/her right of withdrawal, he will return the product with all accessories supplied and in the original shipping packaging to the seller, in accordance with the reasonable and clear instructions provided by the entrepreneur.
2.4 If the returned product is damaged or the packaging is more damaged than necessary to try the product, we may pass this depreciation on to you. So always handle the product with extreme care.
2.5 The consumer can make his/her appeal to the right of withdrawal known by contacting support@cloverliving.com. Only after approval and provision of return details by Clover Living the consumer can return (part of) the order.
2.6 The consumer is obliged to return the product to the consumer within 14 days of the return Clover Living return, failing which his/her right of withdrawal lapses. The costs for returning are at the expense and risk of the consumer.
3. Refund of monies paid and refund of delivery costs
- If the consumer has exercised his/her right of withdrawal in a timely manner and, as a result, has submitted (part of) the order to the consumer in a timely manner, Clover Living has returned, will Clover Living the amount (if any) paid by the consumer, in full or for that part of the order that has been returned, within 14 days of receipt by Clover Living reimburse to the consumer.
- Only if the consumer has returned the entire order in a timely manner as referred to in article 2, will Clover Living also refund the original shipping costs paid by the consumer (if applicable) together with the refund in accordance with clause 2.
4. Refund of return costs
If the consumer exercises his right of withdrawal and returns (part of) the order within the given period, the cost & risk of the return will be borne by the consumer.
